Introduction

Welcome to Sahityo.com (hereinafter referred to as "the Platform", "we", "us", or "our"). Sahityo.com is a multi-author literary platform that allows registered users to sign up and publish their articles, poems, stories, verses, and other literary works. These Terms of Service ("Terms") govern your access to and use of the Platform. By accessing or using Sahityo.com, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

These Terms are published in compliance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and other applicable laws of India.

1. Eligibility

You must be at least 13 years of age to use the Platform. If you are between 13 and 18 years of age, you must have the consent of a parent or legal guardian to use the Platform. By using Sahityo.com, you represent and warrant that you meet these eligibility requirements.

2. User Registration and Account

a. Account Creation

To access certain features of the Platform, such as submitting and publishing content, you must register for an account. During registration, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.

b. Account Security

You agree to notify us immediately at contact@sahityo.com if you become aware of any unauthorized access to or use of your account. We are not responsible for any loss or damage arising from your failure to safeguard your account credentials.

c. One Account Per User

Each user is permitted to maintain only one account on the Platform. Creating multiple accounts may result in suspension or termination of all associated accounts.

3. Content Submission and Author Responsibility

a. User-Generated Content

Sahityo.com is a multi-author platform. Registered users ("Authors") can submit and publish literary content on the Platform, including but not limited to articles, poems, stories, verses, short stories, essays, sonnets, and other literary works.

b. Sole Responsibility of Authors

The authors who post and publish content on the Platform are solely and entirely responsible for the content they share. This includes responsibility for the accuracy, legality, originality, appropriateness, and compliance with applicable laws of all content they submit. The Platform does not, by any means, bear any responsibility for user-submitted content.

By submitting content, you represent and warrant that:

  • You are the original author of the content, or you have obtained all necessary rights, licenses, and permissions to publish the content on the Platform.
  • The content does not infringe upon or violate any intellectual property rights, copyrights, trademarks, patents, or any other rights of any third party.
  • The content does not contain any defamatory, obscene, offensive, hateful, or unlawful material.
  • The content complies with all applicable laws and regulations of India.
  • You have the legal right and authority to publish the content.

c. Content License

By submitting content to the Platform, you grant Sahityo.com a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, distribute, and make available your content on the Platform and through any associated services. This license exists for as long as your content remains on the Platform. You retain ownership of your original content and may request its removal at any time.

d. Content Moderation

We reserve the right, but are not obligated, to review, edit, or remove any content that we determine, in our sole discretion, violates these Terms, is inappropriate, or is otherwise objectionable. We are not responsible for any failure to remove content or for any delay in doing so.

4. Platform Disclaimer and Limitation of Liability

a. No Endorsement

Sahityo.com does not endorse, verify, guarantee, or assume responsibility for any content posted by users. Any views, opinions, statements, or claims expressed in user-submitted content are those of the respective authors and do not represent the views of Sahityo.com.

b. No Liability for User Content

The Platform shall not, by any means, bear any responsibility or liability for any content posted, submitted, or shared by users. This includes, but is not limited to, liability for copyright infringement, defamation, plagiarism, factual inaccuracies, or any other legal claims arising from user-submitted content. All such liability rests solely with the author who submitted the content.

c. Limitation of Liability

To the fullest extent permitted by applicable law, Sahityo.com, its owners, operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to:

  • Loss of data, profits, or revenue
  • Errors, mistakes, or inaccuracies in content
  • Unauthorized access to or use of your account
  • Any conduct or content of any third party on the Platform
  • Any interruption or cessation of services

d. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Comments and Interactions

Users may leave comments on content published on the Platform. Comments reflect the personal opinions of the users who post them and do not represent the views of Sahityo.com. We reserve the right to remove comments that are abusive, offensive, defamatory, or otherwise violate these Terms. Users are solely responsible for their comments and interactions on the Platform.

6. Prohibited Conduct

You agree not to use the Platform for any of the following purposes:

  • Posting content that infringes upon the intellectual property rights or copyrights of others
  • Posting content that is defamatory, obscene, pornographic, vulgar, or offensive
  • Posting content that promotes hatred, violence, discrimination, or illegal activities
  • Engaging in harassment, bullying, stalking, or intimidation of other users
  • Impersonating any person or entity, or falsely representing your affiliation with any person or entity
  • Uploading or transmitting viruses, malware, or any other harmful code
  • Attempting to gain unauthorized access to the Platform, other user accounts, or our systems
  • Using the Platform for any commercial purpose without our prior written consent
  • Scraping, crawling, or using automated tools to access the Platform without permission
  • Engaging in any activity that disrupts or interferes with the proper functioning of the Platform
  • Violating any applicable laws or regulations of India

7. Intellectual Property

The Platform's design, layout, logo, branding, graphics, and all non-user-generated content are the intellectual property of Sahityo.com and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

User-submitted content remains the intellectual property of the respective authors, subject to the license granted to the Platform under these Terms.

8. Copyright Infringement and Takedown

If you believe that any content on the Platform infringes upon your copyright or intellectual property rights, please notify us at contact@sahityo.com with the following information:

  • A description of the copyrighted work you claim has been infringed
  • The URL or location of the infringing content on the Platform
  • Your contact information (name, email, phone number)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement, under penalty of perjury, that the information provided is accurate and you are the copyright owner or authorized to act on the owner's behalf

We will review all valid takedown requests and take appropriate action, including removing the infringing content, in accordance with applicable laws.

9. Account Termination and Suspension

We reserve the right to suspend, deactivate, or permanently terminate your account at any time, with or without notice, if we determine that you have violated these Terms or engaged in conduct that is harmful to the Platform, its users, or third parties. Upon termination:

  • Your access to the Platform will be revoked
  • Your published content may be removed from the Platform
  • We are not obligated to provide you with a copy of your content prior to termination
  • Any provisions of these Terms that are intended to survive termination shall remain in effect

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in our Privacy Policy.

11. Third-Party Links and Services

The Platform may contain links to third-party websites, services, or resources. We are not responsible for the content, privacy practices, or terms of service of any third-party websites. Accessing third-party links is at your own risk, and we encourage you to review the terms and privacy policies of any external websites you visit.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sahityo.com, its owners, operators, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Platform
  • Any content you submit, post, or share on the Platform
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your violation of any applicable law or regulation

13. Modifications to the Platform and Terms

We reserve the right to modify, update, suspend, or discontinue any part of the Platform or these Terms at any time, with or without notice. Any changes to these Terms will be posted on this page with an updated "Last Updated" date. Your continued use of the Platform after any modifications constitutes your acceptance of the revised Terms. We recommend that you review these Terms periodically.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Indian Contract Act, 1872, and other applicable legislation. Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in India.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sahityo.com regarding your use of the Platform and supersede all prior agreements, understandings, or communications, whether written or oral.
